POSTER CHILD GROWS UP TO FLIGHTY TEMPTRESS Telsa Motors once a poster child for a green manufacturing revolution in New Mexico, will not break ground in the state. [nm] The San Carlos, Calif., electric car start-up, which had agreed to build a $35 million plant on Albuquerque's Westside to build the $60,000 four-door, five-passenger Model S sports sedan, announced Monday that the vehicle would be manufactured in California [nm]

HE CAME BACK... In a surprise move, Tesla Motors will build its electric-car factory in the Bay Area, not New Mexico as previously announced, Gov. Arnold Schwarzenegger said today. [m] Most people know Tesla for its fancy electric sports car ..., which can be glimpsed driving down highway 101 near its discreet headquarters in San Carlos. But with $146 million in the bank, Tesla plans to expand into a more mainstream market with a $60,000 sedan, slated for production in two years. [w]

BAITED WITH BREAD Schwarzenegger, along with State Treasurer Bill Lockyer, said California was able to provide Tesla with incentives, including the waiving of state sales tax on $100 million worth of manufacturing equipment, to entice the company to build its assembly plant here. [m] While New Mexico offered a $7 million incentive package to locate the factory there, California upped the ante by offering sales tax exemption for the purchase of manufacturing equipment, and by providing grants for the training of new employees. [w] Toni Balzano, spokeswoman for New Mexico Economic Development, said none of the once-decisive $7 million infrastructure incentives from the state of New Mexico -- $4.5 million of it approved in the last legislative session -- had been spent. [NM]

HE DID IT RIGHT "We want these cutting edge companies not just to start in California and do their research and development here. We want them to build in California," said Schwarzenegger who toured the Tesla headquarters with Lockyer today before his announcement.[m] Unfortunately, it doesn't appear as though Tesla will actually unveil the sedan itself. [w]

SOON TO PICK A CALIFORNIA SITE The exact site has not been selected, but a decision between two locations should come soon, said Darryl Siry, a Tesla vice president. The company will seek a location not too far from its San Carlos headquarters so that its engineers can travel back and forth. Lockyer said Tesla had looked in Hayward, but has now rejected a location there.[m]

AN INDUSTRY ACTUALLY LOOKING FOR AN ENTERPRISE ZONE If Tesla were to choose to locate in one of California's Enterprise Zones, it could see additional tax breaks, Schwarzenegger said. In the Bay Area, those zones - which are used to stimulate business development in depressed areas of the state - are in San Jose, Oakland, Richmond and Watsonville, among other cities. [m]

WHAT IS THIS CAR ALL ABOUT The proposed car, called the Model S — Tesla needs to spend some marketing money on naming its cars — would be able to travel 225 miles on a single charge, carry five people and cost around $60,000. This would be a considerable improvement over the company’s $100,000 Roadster, which is slowly rolling off assembly lines now. [k] California buyers of the Tesla sedan would receive a grant of up to $5,000, but even at $55,000, the Model S won’t be a mainstream solution for cost-conscious consumers. [k]

NEW MEXICO DID NOT COMPETE UNTIL THE FAT LADY SANG In early 2007, the state of New Mexico said Tesla was going to build a 400-employee factory there, to build Tesla's second model, a four-door, five-passenger electric sports sedan for $60,000. The car company was supposed to break ground by spring of 2007, but that never happened because Tesla ran into engineering delays with its first car, a two-seat, $109,000 roadster. It has since begun delivering those cars. [m]

SCHWARZENEGGER ADMITS INSANITY The notion of Tesla, a California start-up, building cars in New Mexico "drove me absolutely insane," said the governor, who is on the waiting list for a Tesla Roadster. [m]

THE GOVERNOR MADE THE DIFFERENCE "We always wanted to be in California," Siry said, but building a factory here is "prohibitively expensive" and New Mexico was seen as a cheaper, close-enough alternative. "But when the governor and state came back and changed their offer it allowed us to do what we originally wanted to do," he said. [m]

AN AUTHORITY WITH AUTHORITY Last week, the California Alternative Energy and Advanced Transportation Financing Authority, which Lockyer chairs, adopted a program exempting makers of zero-emission cars from paying sales and use taxes on equipment. The state actually will buy the equipment for the assembly plant, and lease it to Tesla, which will then not have to pay sales tax on it once Tesla buys the equipment. That will save Tesla about $8 million on $100 million worth of equipment, Lockyer said. The company also is eligible for at least $1 million in training funds. [m] Tesla's Bay Area factory will open in 2010, said Elon Musk, its chairman and largest investor. The company is seeking "a good compromise" on a location that's close enough to its Peninsula headquarters but located in a place where its workers might be able to afford homes within a reasonable driving distance, Musk said. [m] "It'll be close to the Bay, probably near one of the bridges," Musk said. [m]

WAAAA!!!WAAAA!!!WAAAA!!! In New Mexico, state Economic Development Secretary Fred Mondragon said it was "unfortunate that Tesla backed away from its commitment." [m]

GOOD JOB FRED... TAKE THAT PARTING SHOT He also took a shot at the company, saying the decision was "not surprising given the recent instability of its management." [m]

THE INSERTED ONE CHANGED THE POLICY OF THE OUSTED The decisions to locate its factory in New Mexico and to sell batteries came under company co-founder and former Chief Executive Officer Martin Eberhard. He was ousted from the company late last year, a month after Ze'ev Drori became CEO. [m]

TESLAR HAS A HISTORY OF THINKING IT OVER Tesla has a record of changing its mind. In May 2007, it said it would create a battery business and sell $43 million worth of batteries to Think, a Norwegian electric car maker. That deal was scuttled later in the year. [m]

THE OTHER DUDE WANTED IT AND I’M AGAIN IT.... In a blog post on its decision to build a factory in the Bay Area, Tesla CEO Drori noted he conducted a "thorough review of the program's operational and logistical elements" in January. He then decided that the Bay Area, much closer to Tesla's engineering teams, and California, where many of Tesla owners will reside, was the proper home for its factory.[m] Ultimately, he said, the plant will be located "as close to our headquarters as possible." [nm] Tesla Chairman Elon Musk wrote in an e-mail to the San Francisco Business Times that the factory will be in the San Francisco Bay Area. [nm] "One of the mistakes that Tesla made early on was being too spread out around the world," Musk wrote. [nm]

TOMATOES, WILL THEY BE THE DEATH OF US? As salmonella cases continue to climb, the government is investigating whether tainted tomatoes really are to blame for the record outbreak -- or if the problem is with another ingredient or a warehouse that is contaminating newly harvested tomatoes.[f] Tomatoes carrying a rare form of salmonella that has sickened more than 800 people may still be on the market, federal officials said yesterday, two weeks after they first warned consumers about the risk. [w]

OUTBREAK, THATS A SCARY WORD "The facts keep changing here. The outbreak is continuing," Dr. David Acheson, food safety chief at the Food and Drug Administration, said Friday. "We need to reexamine all parts of this system and make sure that the consumer message is still solid."[f]

NATIONWIDE 750-800 PEOPLE SICK At least 17 Massachusetts residents have been sickened by salmonella from raw tomatoes - part of a nationwide outbreak that has struck more than 750 people since April. Salmonella, which comes from animal waste and causes flu-like symptoms, is particularly dangerous for people whose immune systems have already been weakened by age or illness. The Globe's Neil Munshi spoke with Ken Lee, director of the Ohio State University Food Safety Center, about the possible causes of the outbreak, and what consumers should know to eat safely.[b]

SALMONELLA Investigators probing the Salmonella saintpaul outbreak that has sickened at least 810 Americans, including 25 in Maryland, are trying to make sure that tomatoes are the cause, an official of the Centers for Disease Control and Prevention said yesterday.[s]

THE FARMER IN THE DELL, GREW TOMATOES THAT WHEN EATEN SENT US ALL TO... For weeks, the government has focused on tomatoes, and investigators have been visiting farms, warehouses and other stops on the tomato supply chain in search of the source.[s]

EPIDEMIOLOGY? Dr. Patricia Griffin, chief of the CDC's Enteric Diseases Epidemiology branch, said tomatoes remain the likeliest cause, but CDC scientists are also checking salsa, guacamole and produce other than tomatoes.[s]

OTHER PRODUCE? Investigators are considering the possibility that other produce may be spreading the bacteria. "We continue to see a strong association with tomatoes, but we are keeping an open mind about other ingredients," said Patricia Griffin, a top epidemiologist with the Centers for Disease Control and Prevention. [w]

WE ARE MAKING OUR LIST AND CHECKING IT TWICE The government is double-checking because illnesses, which began on April 10, have kept emerging even though it has been weeks since stores and restaurants removed suspect tomatoes. The latest confirmed case of illness was on June 15.[s]

SNOW BIRD ALERT Investigators have focused their attention on Southern Florida and Mexico, the main suppliers of tomatoes to the United States when the outbreak began in mid-April. [w]

MICROBIOLOGISTS Teams including microbiologists and other experts have spent the past week in both places, scouring farms, packing sheds and warehouses for evidence of the outbreak strain. They have collected more than 1,700 samples from fields, irrigation wells and storage containers, Acheson said, but so far none have tested positive. [w]

OF THE USUAL SUSPECT, VILLIAN NUMBER ONE Tomatoes remain the top suspect, and the advice on which ones consumers should avoid has not changed, Acheson said. But the widening outbreak -- with at least 810 people sickened -- means whatever is making people ill could still be on the market.[f] Red roma, red plum, and round red tomatoes are on the contaminated list, but cherry, grape, and vine-on tomatoes are safe.[b] To be extra cautious, cook all tomatoes. But most grocers have been very responsible in only selling tomatoes that aren't implicated in the outbreak, Lee said. Canned goods and salsa - which is pasteurized - are also safe. The government has narrowed its search for the source of the outbreak to farms in Mexico and Florida, so you're safe if you avoid tomatoes from those areas. The problem is that a single box of tomatoes may contain fruit from many farms in different parts of the country or the world. The US Food and Drug administration, which regulates farms, may consider more clearly marking tomatoes with point-of-origin labels in light of this outbreak, Lee said.[b]

JUST DO NOT GO TO A RESTAURANT OR SUPERMARKET Most worrisome, the latest victim became sick June 15 -- long after the outbreak began April 10 and weeks after government warnings removed many tomatoes from supermarkets and restaurants.[f] Tomatoes On My Windowsill by Robin Benzle Tomatoes on my windowsill, Lined up like happy soldiers, From pale green as 1. key lime pie To red as sunburned shoulders. They seem to smile at the sun, While they patiently a-ripen. And when I do my kitchen chores, I smile back, enlightened. Then to my garden I return To pluck another load, And tenderly I line them up On that shelf in my abode. No sooner do I get them shelved, Than my garden calls me back. They're ripening all at once, I think, As I stuff them in my sack. So I give them to my neighbors and I give them to my friends. I give them to my enemies, Just to make amends. Soon, I note they're turning red So fast it makes me ill. From off the vine, they drop like flies. My plot looks like road kill. Tomatoes on my windowsill All rotting in a row. I never thought I'd say this but, "Where the hell's the snow?" [t]

SOURCE "The source of contamination has been ongoing at least through early June, and we don't have any evidence that whatever the source is, it's been removed from the market," said Dr. Patricia Griffin of the U.S. Centers for Disease Control and Prevention.[f] Q: How did the tomatoes become tainted? A: Tomatoes are warm when they come off the vine, having been heated by the sun, and are cooled once they are picked, causing them to contract. This contraction, Lee said, may effectively suck all the bacteria and dirt on the surface of the tomato inside, through the stem and button areas. Scarred or bruised tomatoes should be avoided, as those are extra access points for the bacteria. Lee said studies have dismissed the idea that the bacteria could have traveled up into the plant through the roots.[b] It's not clear why the outbreak occurred now.[b] Acheson said the investigation has proved especially difficult because of the timing of the outbreak and a common industry practice called repacking. The illnesses began just as the main source of tomatoes shifted from Mexico to Florida. [w] After they are picked, tomatoes are often repacked to meet the customer specifications. In the process, tomatoes from many farms are combined, making it harder to trace a shipment to a particular restaurant, for example, back to where it was grown. [w]

AVOID RED OR BE DEAD? The FDA urges people to avoid raw red plum, red Roma or red round tomatoes unless they were grown in states or countries that the FDA has cleared of suspicion.[f] We have to re-examine the whole thing," David Acheson, a top food safety official with the Food and Drug Administration said. "We are concerned there is something out there still exposing people to this salmonella saintpaul strain." [w]

“When it comes to the hiring of nonpartisan career attorneys, our system of justice should not be corrupted by partisan politics,” said Representative John Conyers Jr., the Michigan Democrat who is chairman of the Judiciary Committee. “It appears the politicization at Justice was so pervasive that even interns had to pass a partisan litmus test.”[n]

NO JUSTICE IN THIS JUSTICE DEPARTMENT..IN HIRING AND FIRING... Justice Department officials blocked liberals and people with Democratic Party ties from a highly selective program that funneled young lawyers into government jobs, according to an internal investigation released Tuesday.[c] Investigators are also looking into whether those firings were prompted by partisan political reasons, whether former Attorney General Alberto Gonzales and his aides misled Congress, and whether civil-rights and voting-rights cases were politicized. Those studies could be issued soon, according to lawyers following the issues.[s] Former Attorney General Alberto Gonzales, now under investigation for allegedly politicizing the Justice Department, ousted a top lawyer for failing to adopt the administration's position on torture and then promised him a position as a U.S. attorney to placate him, highly placed sources tell ABC News. [A2]

ITS OKAY TO BREAK THE LAW TO KEEP THEM LEFTISTS OUT The report, prepared by the Justice Department’s own inspector general and its ethics office, portrays a clumsy effort by senior Justice Department screeners to weed out candidates for career positions whom they considered “leftists,” using Internet search engines to look for incriminating information or evidence of possible liberal bias. [n]

IDEOLOGICAL!, WE WANT JUSTICE LAWYERS BRED OUR WAY... Justice Department officials illegally used "political or ideological" factors in elite recruiting programs in recent years, tapping law-school graduates with conservative credentials over more qualified candidates with liberal-sounding résumés, an internal report found Tuesday.[S] Scores of highly credentialed young lawyers and law students were denied interviews for coveted positions at the Justice Department because of an illegal screening process that took political and ideological views and affiliations into account rather than merit, Justice Department investigators concluded in a report released Tuesday.[l] Both Justice Department policy and federal law prohibit discrimination in hiring for career positions on the basis of political affiliations.[c] The Democratic-controlled Congress has been engaged in battle for months with the White House over information about the dismissal of the attorneys and the prosecution of Siegelman. [c2] Current and former White House aides have refused to testify, citing executive privilege.[c2]

INSPECTOR GENERAL IS NOW A WHISTLE BLOWER Esther Slater McDonald, a political appointee at the Justice Department, "wrote disparaging statements about the candidates' liberal and Democratic Party affiliations on the applications she reviewed and ... she voted to deselect candidates on that basis," said the report by Inspector General Glenn Fine. McDonald, who has left the department, refused to be interviewed for the investigation.[c]

NEW LAWYER SET UP TO TAKE THE FALL Much of the report's focus is on a 2003 law school graduate, Esther Slater McDonald, who was hired as a counsel to acting Associate Atty. Gen. William Mercer in June 2006 after being recommended by former Gonzales aide Goodling. Despite her inexperience, McDonald was named to the three-person committee that decided which applicants recommended by department sections would get interviews for the highly competitive intern and honors jobs. [l]

WHAT DO CLINTON, PARENTHOOD AND MYSPACE HAVE IN COMMON?...NO JOB... One rejected candidate from Harvard Law School worked for Planned Parenthood. Another wrote opinion pieces critical of the USA Patriot Act and the nomination of Samuel Alito Jr. to the Supreme Court. A third applicant worked for Sen. Hillary Rodham Clinton and posted an unflattering cartoon of President Bush on his MySpace page.[s]

BUSH DID NOT WANT THE BEST AND THE BRIGHTEST..ONLY THE CONSERVATIVE BRAIN WASHED(ASSUMING THERE IS ONE) AND COMPLIANT Other students or graduates brushed aside include a University of Alabama law graduate, ranked sixth in the class, who had written a paper on the detention of foreigners under the USA Patriot Act; a Yale Law School graduate who was fluent in Arabic; and a Georgetown law student who had worked for Sen. John F. Kerry's presidential campaign.[l]

ONLY JONES (WHITE BREAD)UNIVERSITY LIKE, ALMA MATTER NEED APPLY Another applicant, a student at the top of his class at Harvard who was fluent in Arabic, was relegated to the “questionable” pile because he was a member of the Council on American-Islamic Relations, a group that advocates civil liberties. And another rejected candidate said in his essay that he was “personally conflicted” about the National Security Agency’s program of wiretapping without warrants. [n]

CAREER PROSECUTOR POLITICALIZED The report, the first official investigation to document politicization of the Justice Department during the Bush administration, is an offshoot of the larger investigation of Justice Department politics triggered by the furor over the firing of nine U.S. attorneys.[c] Justice Department officials illegally used “political or ideological” factors in elite recruiting programs in recent years, tapping law school graduates with Federalist Society membership or other conservative credentials over more qualified candidates with liberal-sounding résumés, an internal report found Tuesday. [n]

BUSH’S BRAIN TO GET LOBOTOMY! The House Judiciary Committee served a subpoena on former top Bush aide Karl Rove on Thursday to compel his testimony concerning allegations that the Department of Justice had dismissed U.S. attorneys based on party affiliation.[c2]

BUSH ADMINISTRATION ROTTEN TO THE CORE It found two of three members of a screening committee considered political views and experience when choosing new lawyers for the Justice Department Honors Program and Summer Law Intern Program.[c] The report found that McDonald and Michael Elston, the chief of staff to Deputy Attorney General Paul McNulty, engaged in misconduct, an administrative violation. The third member of the screening committee, career lawyer Dan Fridman, was cleared of any involvement in the politicization of the process.[c] Elston was interviewed by the investigators, who asked him about the role of former Justice Department official Monica Goodling in politicizing the selection process.[c]

THIS MICHAEL SAYS NO WACKOS TO APPLY...HERE..TRY THE WHITE HOUSE IN 2008 The report also notes that Michael Elston, former deputy chief of staff to the deputy attorney general, told a member of the search committee to weed out "Wackos" and "Wack Jobs." [a]

FROM THE LOWEST TO HIGHEST RINGS OF POWER ACCOUNTABILITY IS AT HAND. The committee ordered Rove to appear July 10 to testify on claims that he was a key player in pressing the Justice Department to dismiss some U.S. attorneys and to prosecute Democrats.[c2]

ROVE WILL NOT VOLUNTARILY HONOR A SUBPOENA TO TESTIFY, CONGRESS DOES NOT HAVE ENOUGH AUTHORITY GIVEN CARLS.... STATUS It had authorized the subpoena earlier but delivered it Thursday after Rove's attorney said he would not appear voluntarily, Chairman John Conyers, D-Michigan, said in a written statement.[c2] "It is unfortunate that Mr. Rove has failed to cooperate with our requests," Conyers said. "Although he does not seem the least bit hesitant to discuss these very issues weekly on cable television and in the print news media, Mr. Rove and his attorney have apparently concluded that a public hearing room would not be appropriate. Unfortunately, I have no choice today but to compel his testimony on these very important matters."[c2] "Today's report confirms that the Bush administration was engaged in a deliberate effort to inject partisan politics into the administration of justice," said Sen. Sheldon Whitehouse (D-R.I.), a member of the Senate Judiciary Committee. The honors and summer intern programs, he said, "were made into a recruitment firm for conservatives, rewarding ideology with career advancement."[l]

LYERS IN THE RANKS Elston told investigators he could not recall Goodling telling him to select lawyers who appeared to share Attorney GeneralAlberto Gonzales' philosophy. Goodling testified before a House panel last year that she had told Elston he should identify such candidates.[c] Goodling directed Elston to lead the selection committee in 2006. She and Elston have both left the Justice Department. She refused to be interviewed for the inspector general's report.[c]

OOPPSEY DAISY..BETTER CHANGE THE POLICY.. As a result of the controversy, the hiring process was changed in 2007 to insulate hiring decisions from political considerations.[c] Attorney General Michael Mukasey, who replaced Gonzales last year, said Tuesday that using politics in hiring career lawyers was "impermissible and unacceptable" and that the department had taken steps to fix the problems. The report recommended further tightening of internal policies, which Mukasey said he would welcome.[s]

IT IS AGAINST LAW AND POLICY.... Both Justice Department policy and federal law prohibit discrimination in hiring for career positions on the basis of political affiliations.[c] The report did not find clear evidence that an earlier screening committee took political considerations into account. It says data from 2002 shows a disparity in the hiring of liberal and conservative candidates, but there were no complaints about the committee's work from 2003 to 2006, when Goodling put Elston in charge of the process.[c]

A REVIEW UNDERWAY RE: OUR CONSERVATIVE REPUBLICAN , IN BRED WHITE BREAD, NON-JUSTICE DEPARTMENT The report Tuesday is the first of perhaps several to be issued as the broad-ranging investigation into the role partisan politics has played in the Justice Department during the Bush [c] administration.[c]

JUST AS LONG AS THEY SPELL HIS NAME RIGHT Goodling is expected to be a central figure in later inspector general reports examining efforts to increase the influence of conservatives in the department.[c]

JOINERS... The Justice Department Office of Professional Responsibility, a separate watchdog office that monitors prosecutorial conduct, joined in the inspector general's investigation. [c]

GOOD PEOPLE ON THE INSIDE STARTED THIS REVIEW Allegations about improper hiring practices in the programs surfaced in an anonymous April 2007 letter sent to Congress signed by "A Group of Concerned Department of Justice Employees." The claim prompted the internal review. [a]

20 YEARS AND NO LEADERSHIP ACTION!...CHANGE LEADERS! Exactly 20 years after warning America about global warming, a top NASA scientist said the situation has gotten so bad that the world's only hope is drastic action. [y] Why are we in such disagreement on this issue?[trb] "We have reached an emergency situation" said Hansen and warned lawmakers that it was almost too late to defuse what he referred to as the global warming ticking time bomb.[TH] What will diffusing look like? Who has the leadership on this issue?[trb]

20 YEARS TO ECOSYSTEM COLLAPSE..WHAT WILL HAPPEN FIRST? James Hansen told Congress on Monday that the world has long passed the "dangerous level" for greenhouse gases in the atmosphere and needs to get back to 1988 levels. He said Earth's atmosphere can only stay this loaded with man-made carbon dioxide for a couple more decades without changes such as mass extinction, ecosystem collapse and dramatic sea level rises.[y]

TRY GRAPE JAM AND BUTTER WITH IT "We're toast if we don't get on a very different path," Hansen, director of the Goddard Institute of Space Sciences who is sometimes called the godfather of global warming science, told The Associated Press. "This is the last chance."[y] "The greenhouse effect has been detected, and it is changing our climate now," Hansen said, according to aWashington Post account of the hearing. "We already reached the point where the greenhouse effect is important." [w] Christopher Flavin of the Worldwatch Institute said Hansen's testimony made a crucial point: that rising temperatures were a problem for the present, not just for future generations. [w]

I TOLD YA SO Hansen brought global warming home to the public in June 1988 during a Washington heat wave, telling a Senate hearing that global warming was already here. To mark the anniversary, he testified before the House Select Committee on Energy Independence and Global Warming where he was called a prophet, and addressed a luncheon at the National Press Club where he was called a hero by former Sen. Tim Wirth, D-Colo., who headed the 1988 hearing.[y] The earth has been warmer in the first five months of this year than in any comparable period since measurements began 130 years ago, and the higher temperatures can now be attributed to a long-expected global warming trend linked to pollution, a space agency scientist reported today.[N]

JUNK THE COAL FIRED PLANTS To cut emissions, Hansen said coal-fired power plants that don't capture carbon dioxide emissions shouldn't be used in the United States after 2025, and should be eliminated in the rest of the world by 2030. That carbon capture technology is still being developed and not yet cost efficient for power plants.[y]

CONTINUING TO BURN FOSSIL FUEL WILL MAKE US ALL FOSSILS Burning fossil fuels like coal is the chief cause of man-made greenhouse gases. Hansen said the Earth's atmosphere has got to get back to a level of 350 parts of carbon dioxide per million. Last month, it was 10 percent higher: 386.7 parts per million.[y] On this anniversary of his first landmark testimony, Hansen once again appeared before Congress today. This afternoon, he told the House Select Committee for Energy Independence and Climate Change that the chief executives of large fossil fuel companies should be put on trial for crimes against humanity and nature. He argued that global warming science has been corrupted in the same way that tobacco companies once attempted to blur the links between smoking and cancer, and he called for government investments in alternative energy to help end our dependence. He also asserted that because we haven't done anything yet to curb our emissions, he is certain that the concentration of CO2 in the atmosphere is already beyond the safe level – we're already at 385 parts per million of carbon dioxide, and it's increasing at a rate of 2ppm a year. The "safe" level, according to Hansen, is 350.[g]

PROTESTS ANYONE... Hansen said he'll testify on behalf of British protesters against new coal-fired power plants. Protesters have chained themselves to gates and equipment at sites of several proposed coal plants in England.[y] "The thing that I think is most important is to block coal-fired power plants," Hansen told the luncheon. "I'm not yet at the point of chaining myself but we somehow have to draw attention to this."[y]

SIMPLISTIC Frank Maisano, a spokesman for many U.S. utilities, including those trying to build new coal plants, said while Hansen has shown foresight as a scientist, his "stop them all approach is very simplistic" and shows that he is beyond his level of expertise.[y]

DEBATE HEATS UP The year of Hansen's original testimony was the world's hottest year on record. Since then, 14 years have been hotter, according to the National Oceanic and Atmospheric Administration.[y] Two decades later, Hansen spent his time on the question of whether it's too late to do anything about it. His answer: There's still time to stop the worst, but not much time.[y] "We see a tipping point occurring right before our eyes," Hansen told the AP before the luncheon. "The Arctic is the first tipping point and it's occurring exactly the way we said it would."[y] Hansen, echoing work by other scientists, said that in five to 10 years, the Arctic will be free of sea ice in the summer.[y] This anniversary comes just after a major setback for environmentalists, as a bill that would have begun to regulate greenhouse-gas emissions failed in the Senate. [w] Longtime global warming skeptic Sen. James Inhofe, R-Okla., citing a recent poll, said in a statement, "Hansen, (former Vice President) Gore and the media have been trumpeting man-made climate doom since the 1980s. But Americans are not buying it."[y] But Rep. Ed Markey, D-Mass., committee chairman, said, "Dr. Hansen was right. Twenty years later, we recognize him as a climate prophet."[y] ...in an op-ed, NYT columnist Thomas Friedman offers up what he believes should be the next president’s energy policy: Oil is poisoning our climate and our geopolitics, and here is how we’re going to break our addiction: We’re going to set a floor price of $4.50 a gallon for gasoline and $100 a barrel for oil. And that floor price is going to trigger massive investments in renewable energy — particularly wind, solar panels and solar thermal. And we’re also going to go on a crash program to dramatically increase energy efficiency, to drive conservation to a whole new level and to build more nuclear power. And I want every Democrat and every Republican to join me in this endeavor. Friedman likened President Bush’s call for more domestic oil exploration to the pleas of crack dealer. After diagnosing America as “addicted to oil, Friedman writes, Bush’s plan seems to be “Get more addicted to oil.” [e] –END

THE POT IS CALLING THE KETTLE BLACK Saudi Arabia's King Abdullah condemned oil "speculators" on Sunday at a summit on the spiralling price of crude which called for greater transparency in market dealings.[a] The speculators may have a role but the big villian is Saudia Arabia itself. They are holing down supply.[trb] While reaping record profits, Saudi Arabia is also growing increasingly concerned that oil current prices might eventually dampen economic growth around the world and lead to lower oil demand, as is already happening in the United States and other developed countries. [n]

ONLY SEVERAL COUNTRIES ARE UPSET OVER THE LOSS OF THE MIDDLE CLASS BECAUSE OF INCREASED FUEL COSTS? ABDULLAH MUST NOT GET OUT MUCH! Saudi output has risen to 9.7 million barrels a day (bpd), the king said, vowing to further increase production if necessary to defuse market tensions which have sent the price of a barrel of oil up to almost 140 dollars -- sparking angry protests in several countries.[a] An emergency energy summit meeting convened hastily here on Sunday underscored how few options the world has to push oil prices down from their record levels, as producers and consumers repeatedly emphasized starkly divergent views on both the fundamental causes and possible remedies for the current energy crisis.[n] Politicians in oil-consuming and oil-producing nations fear that rising prices could contribute to a global recession that would hurt all sides. [cm] It is not unusual for countries to go to war to secure something that they need and do not have. It looks now as if we have had two modern oil wars (can anybody doubt that the USA and Europe would have bothered to liberate Kuwait, or Iraq invade it, if it did not have the sixth – depending on statistics – largest oil reserves?) It is probable that there will be many more in the decades to comes.[w]

IS A MONARCH A DICTATOR WITH A CROWN? OR JUST A FOX IN THE CHICKEN KOOP! The monarch, who said Saudi Arabia would give 1.5 billion dollars to efforts to ease energy shortages in poor nations, told the 36-nation summit his country was "very concerned" about consumers worldwide.[a] For Saudi Arabia, the meeting was a rare foray into the spotlight, and an opportunity to underscore that the oil-rich kingdom was aware of growing anger and frustration caused by surging prices in oil-importing countries. [n] A seven-fold increase in the cost of oil since 2002 is causing growing economic and political pain in both industrialized countries and the developing world. [n]

THE PAIN WILL BECOME MORE INTENSE The International Energy Agency estimates that world oil use this year will climb 800,000 barrels a day, or 1 percent, as demand climbs in emerging markets. Stagnating production from Russia and the North Sea and disruption in Nigeria are also contributing to higher prices, which have touched off strikes, riots and accelerating inflation in nations around the world. [B]

I BELIEVE HE JUST LOOKED IN THE MIRROR He blamed increased oil consumption and taxes on fuel, but added: "Among other factors behind this unjust increase in oil prices is the abhorrent act of speculators acting for their own selfish interests."[a] The pain of escalating oil prices - crude sold for more than $134 a barrel on Friday, double year-ago levels - have cascaded throughout the U.S. economy. [c] Oil has become a hot-button political issue as the cost of gasoline, diesel and jet fuel have spiked in recent months. Congress has scheduled hearings this week to debate legislation that would attempt to dampen prices.[c]

HOW IRONIC THAT THE REPUBLICAN FREE MARKETEERS ARE SO QUIET ABOUT THESE SAUDI THIEVES... IT’S A MONOPOLY FREE MARKET SUPPLY AND DEMAND PREDICTORS OF PRICE DO NOT WORK IN THIS MONOPOLY! The summit in the Saudi Red Sea city of Jeddah was the scene of an international debate over the cause of the doubling of oil prices in the past year.[a]

OBAMA ITS THE OIL COMPANIES DOING IT TO US Obama targeted the oil companies and traders after rejecting calls by both McCain and Bush to lift a ban on offshore oil drilling that has been in place for more than a quarter century.[i]

THE LOGIC HERE IS THAT THE SPECULATORS HAVE CAUSED PRODUCTION SHORTFALLS...REMEMBER IT IS A MONOPOPLY SUPPORTED (PROTECTED) BY YOUR GOVERNMENT ...THE SAUDIS SET SUPPLY. The United States and other Western powers blamed production shortfalls while Saudi Arabia and other Organisation of Petroleum Exporting Countries (OPEC) members said speculators have played a key role.[a] On Saturday, U.S. Energy Secretary Samuel Bodman, attending the Saudi summit, attributed the record-high oil prices to lagging production.[c] Bodman said he did not believe speculators are the cause of high oil prices.[c] Since 2003, he said, global demand for oil has increased because of industry in China, India and the Middle East. But from 2005 to 2007, there was very little increase in supply.[c] Nations need an additional supply of energy to market, whether that energy is nuclear, coal, fossil fuels, solar or wind power, Bodman said.[c] "We spent 30 years digging ourselves into this hole," Bodman said. "It won't be solved soon."[c]

THE ISSUES ARE COMPLEX AND THE WORLD MUST EXERT STRONG PRESSURE TO CAUSE CHANGE. But for many Western governments, the prime culprit is a lack of enough oil to meet growing demand, principally from booming economies in China and India. [cm] "Fundamentally tight market conditions, in our view, are the main driver of price increases that we have seen over the last five years and particularly during recent months," Mr. Bodman told reporters. [cm] The kingdom – the only major exporter with enough capacity to significantly increase production – is under intense pressure from Western governments to increase output. Angered by high oil prices, Congress has initiated moves – so far unsuccessful – to force Saudi Arabia's hand. These have included a proposed halt to a major US arms sales package to Riyadh and draft legislation to allow US prosecutors to charge OPEC countries with antitrust violations. [cm]

REGULATION OF AN INTERNATIONAL MONOPOLY, WHAT DO YOU SUGGEST? The final communique by leaders and ministers from the 36 nations called for greater regulation of oil markets and greater investment in refining capacity.[a] "The transparency and regulation of financial markets should be improved through measures to capture more data on index fund activity and to examine cross-exchange interactions in the crude market," the statement said.[a] OBAMAS PLAN Sen. Barack Obama rolled out a proposal yesterday to curb speculation in energy markets, which his advisers said would help stabilize soaring gasoline prices. [wp] The presumptive Democratic presidential nominee laid out a four-step program that would, among other things, close an "Enron loophole" that protects some trading in energy futures from federal oversight, his advisers said. [wp] "I think everyone believes there's too much speculation in the oil markets, and a lot of it flows directly from that particular loophole," New Jersey Gov. Jon S. Corzine (D) said on a conference call hosted by the Obama campaign. [wp] The three other components of the plan, as described by Obama economic adviser Jason Furman, are to ensure that U.S. energy futures cannot be traded in offshore, unregulated markets; to work toward international regulation of oil futures markets, in cooperation with like-minded countries; and to have both the Federal Trade Commission and the Justice Department investigate the oil markets. [wp]

Obama blamed former Republican Senator from Texas Phil Gramm, who serves as an economic adviser of his presidential rival, John McCain, for inserting a provision into the bill in 2000 "at the behest of Enron lobbyists" that exempted some energy traders from government oversight.

MC CAIN'S PLAN INEFFECTIVE The U.S. economy went into a nose dive last year as shaky home mortgage practices began to unravel, leading to foreclosure rates not seen in decades.[i] That, combined with rocketing oil prices and growing unemployment, have led Obama to charge that McCain's economic policies represent little more than a continuation of programs instituted by President George W. Bush, the 71-year-old Arizona senator's fellow Republican.[i]

HOW MUCH INVESTMENT IN REFINING CAPACITY IS BEING ARGUED BY THE PRESIDENTIAL CANDIDATES? It added: "An appropriate increase in investment, both upstream and downstream, is necessary to ensure that the markets are well supplied in a timely and adequate manner."[a] OPEC was split, however, over whether to follow the Saudi lead in increasing output.[a] Kuwait said it was ready to increase production, but the OPEC president -- Algeria's Oil Minister Chakib Khelil -- insisted this was not necessary.[a]

AMERICA SAYS THE SAUDI DICTATOR / MONARCH IS WRONG! US Energy Secretary Samuel Bodman said "there is no evidence that we can find that speculators are driving futures prices" to current record heights.[a]

MARKET MANIPULATION ANYONE! He told the meeting: "Market fundamentals show us that production has not kept pace with growing demand for oil, resulting in increasing -- and increasingly volatile -- prices."[a]

ASK YOUR SELF ...Q: AT WHAT PRICE PER GALLON OF GASOLINE WOULD YOU SUPPORT INVADING THE OIL PRODUCING COUNTRIES AND SEIZING THE OIL FIELDS? A:Would it be a pump price of $20 per gallon, $15, $10, $9,$8, $7, $6, $5, or $4 (bombs away).[trb] Warning that prices would almost certainly rise further, Bodman said: "In the absence of any additional crude supply, for every one percent increase in demand we would expect a 20 percent increase in price in order to balance the market."[a]

LOCK AND LOAD......currently $ 134 a barrel soon $200 a barrell... a 30% increase at the pump $4 x 1.30= $5. When do we start the draft and redeploy or armies? Or do we invest in alternative fuel and create policies , that do not include higher pump prices, to lower demand.[trb] “This means we will have $200 a barrel oil,” said Mohammed H. A. Abudawood, a prominent businessman and member of the Jeddah Economic Forum, after the speeches were finished and the delegates began drifting out of the room.[n]

THE MARKETS ARE GAMBLING AND THE WORLDS POPULATION IS GETTING VERY ANGRY German Economy Minister Michael Glos told the summit an increase in production would be "a strongly needed signal to the financial markets to not gamble any more on an increasing oil price."[a] India's Finance Minister P. Chidambaram and Australia's Resources and Energy Minister Martin Ferguson also called for increased output.[a]

IF THEIR SURVIVAL IS THREATENED THEY WILL SUPPORT A MARKET ADJUSTMENT, NOT TILL THEN. Kuwaiti Oil Minister Mohammed al-Olaim said OPEC members "will not hesitate" to increase production if the market needs it.[a] But OPEC chief Khelil insisted there is enough oil to supply the market.[a]

IF THERE IS NO SUPPLY PROBLEM THEN THE WORLD IS BEING RIPPED OFF "We believe that the market is in equilibrium. The price is disconnected from fundamentals. It is not a problem of supply."[a]

NEXT MEETING IN SEPTEMBER , WE WILL SEE WHO STILL HAS TERRITORIAL SOVERINTY? Khelil said the 13-nation OPEC would only consider a production increase at a meeting in September.[a]

OPEC IS BLAMING AMERICA.... "We believe speculation, in its noble and not noble terms, has its impact," the OPEC chief said, also blaming "uncertainties on the dollar" for the soaring price.[a] THEY SAY THEY HAVE OIL TO SPARE A Saudi source said there is scope for other countries to follow the production increase as there are up to three million barrels of spare capacity within OPEC nations.[a]

WE WANT A NEW DEAL OR IT WILL BE A NEW DAY British Prime Minister Gordon Brown, senior Western leaders at the summit, called for a "new deal" between consumers and producers.[a] But like many Europeans at the meeting he said production shortages and speculation had to be studied.[a] Brown said that the world was going through "the biggest of all three oil shocks" in recent decades.[a]

OUR ARMIES ARE IN THE WRONG COUNTRIES Saudi Oil Minister Ali al-Nuaimi said, however, that the world has enough crude to last "many decades" and that Riyadh will invest 129 billion dollars to be able to produce 15 million barrels a day (bpd).[a] Nuaimi said Saudi Arabia's production capacity will rise to 12.5 million bpd by the end of 2009 and another 2.5 million bpd could be added if demand warranted.[a]

RESOURCES ARE NEEDED TO DEVELOP ALTERNATIVE FUEL, IF WE CAN FUND THE HALBURTON WARS WE CAN FUND THIS RESEARCH. But asked how all this would help remedy the worst oil crisis in decades, some ministers seemed baffled and uneasy. [n] “Let me ask you,” said India’s oil minister, Murli Deora, when a group of reporters asked him for his views on how to address the crisis. “what else can we do to bring harmony between buyers and sellers?”[n] Oil wars seem inevitable. Even if the OPEC countries wanted to be ‘fair’ and allocate the oil evenly when production declines, it would mean that major users would face shortages and high prices. Will an American or Chinese leader stand back in the face of rising prices and domestic unrest or will they resort to military pressure, maybe on the pretence of terrorist threats or instability? We have grown used in the latter half of the Twentieth Century to major countries fighting economically or by proxy, forgetting the thousands of years of near-perpetual conflict that occurred before. The wars of the Twenty First Century could be the first sign of a return to a historical way of life, a regression in civilisation.[w]

*** REFLECTION: I have found it impossible to second guess police use of force from a media article. The real question is who polices the police on a use of deadly force question. Here we have two local officials that have the closet relationship to the police, the sheriff and prosecutor standing behind the officers. The State police were involved...lets hear from them. Two police officers have been cleared in the shooting death of mentally ill man who claimed to have a gun but was actually holding a cellphone.[f]

STATE AND COUNTY OFFICERS KILL MENTALLY ILL MAN State police and Genesee County Sheriff's deputies were checking out a trouble call about 5 p.m. Nov. 23 and found Kevin Simmonds, 31, of Otisville in a car in a wooded area near Dodge and Cemetery roads.[f]

SHINY OBJECT Holding a "shiny object" in his hand, Simmonds shouted "I have a gun, I have a gun" at police, said Genesee County Prosecutor David S. Leyton.[f]

THE OFFICERS ONLY NEEDED TO BELIEVE HE HAD A GUN "The law does not demand that your perceived antagonist have a real weapon in order for you to employ lethal force in self defense. It only demands that his actions create in your mind a reasonable and prudent belief that he has a weapon. If he is close enough to employ such a weapon, and if his actions are consistent with an armed person trying to kill you (Diallo turned suddenly and thrust the hand with the black object toward the officers), then the requirements have been met for you to justifiably use deadly force in order to defend your own life."[s] Unable to tell exactly what he was holding in the fading daylight, police ordered Simmonds to drop it but he refused.[f]

AFTER THWART SHOTS FIRED Police tried to stun him in the car with a Taser, but were thwarted by Simmonds' winter jacket, Leyton said.[f]

THE FURTIVE MOVEMENT DEFENSE When Simmonds made a "furtive" movement, Leyton said a state trooper and sheriff's paramedic opened fire striking Simmonds multiple times.[f] "A furtive movement in such cases is a movement reasonably consistent with going for a weapon and not reasonably consistent with anything else under the circumstances.[s]

DID THE OFFICERS REALLY KNOW THIS BEFORE THEY FIRED Given the situation and the fact that Simmonds had a history of mental illness and threats, Leyton said the officers had reason to believe Simmonds was armed.[f] A couple of notes on the furtive movement: 1. It cannot possibly be construed as an innocent gesture; 2. Nervousness alone does not constitute furtive movement. "Furtive" means secretive or concealing. "Suspicious" is not the same as "furtive". 3. The way you need to think about it and articulate it is that the attacker is trying to conceal or hide a movement toward a weapon or to otherwise set up an attack. This can include the famous "pretend-to-walk-away-and-throw-the-big-haymaker-punch".[s] Unfortunately, there is a large grey zone here. The movement toward drawing a gun from a back pocket or the back of a waistband is exactly the same movement someone would make toward their wallet. The movement toward drawing a knife from a front pocket is exactly the same movement one would make in pulling out their keys.[s]

SO WHAT Investigators later found a long gun laying in the snow several yards from him.[f] The police accounts of the shooting were backed up by a patrol car video that recorded the incident.[f]

CHOICES...TRY TRAINING PROFESSIONALISM EXPERIENCE...THEY WERE PLENTY OF CHOICES, THERE DECISION WAS TO PICK THE OPTION OF SHOOTING Genesee County Sheriff Robert J. Pickell said his deputy had no other choice but to shoot.[f]

DEAD CITIZEN UPSET OFFICER "It's regrettable that somebody had to die," said Pickell. "He did what he thought he had to do and I stood behind him."[f] State police officials at the Flint post could not be reached for comment Thursday afternoon.[f]

FAMILY OF DEAD CITIZEN MOURNS Simmonds' father, Daniel, said he was unaware Thursday afternoon that the officers had been cleared and declined comment on the decision.[f] In the immediate wake of the shooting, family members had said Kevin Simmonds suffered from bi-polar disorder and severe manic depression.[f] The LakeVille High School graduate had worked as an electrician with contractors in the Flint and Waterford Township areas.[f]

Flint continues to mutilate itself or commit self harm (SH)

TRUTH , JUSTICE AND THE FLINT WAY OF LIFE The city is fighting itself in court this week.[F] The City of Flint Contiunes to practice (SH)[trb] See[w] George Hamo, an attorney who works on behalf of Mayor Don WIlliamson, said the mayor sued the City Council on Monday.[F]

THE COUNCIL IS WAY OUT OF BOUNDS Hamo said the Council overstepped its bounds when it approved a $66-million budget with numerous changes to Williamson's proposed budget.[F]

THE MAYOR DID NOT GET WHAT HE DEMANDED Councilman Scott Kincaid said the budget is legal, and it's merely a case of sour grapes on the mayor's part.[f2]

COUNCIL- YOU CANNOT DISMANTEL CITY GOVERNMENT, JUST TO PROVE A POLITICAL POINT The Council did not have the authority to eliminate the labor relations department, Hamo said, one of several instances where the council tried to grab too much power.[F] "They were trying to take over control of the executive branch," Hamo said. "They were doing it for one reason and one reason only. Simply to try to make the mayor look bad."[F] Others can argue this is just the Flint Governmental tendency to inflict harm upon itself.[trb] These acts may be aimed at relieving otherwise unbearable emotions, sensations of unreality and numbness. The illness is listed in the Diagnostic and Statistical Manual of Mental Disorders (DSM-IV-TR) as a symptom of borderline personality disorder and depressive disorders. [w]

WE HAVE BEEN DOWN THIS PATH BEFORE "Here we go. Back in court again," said Councilwoman Sandy Hill, who is hoping to broker a compromise between the Council and Williamson. "We don't need this. What good is it going to do us? I'm afraid it's all going to be tied up in court and nothing is going to be done." [F] Hamo said some departments, such as labor relations, were cut so deeply they can't function.[F] "The Council is trying to obliterate administrative offices purposely. This is not good managing of the city," Hamo said.[F] The City Council cut the city administration and other departments in order to restore some police and fire positions cut in Williamson's proposed budget. [F] Even though some positions were saved, 46 police officers were given pink slips last week.[F] Hamo said in addition to filing the lawsuit, the city administration will be attempting to persuade a judge to file an injunction that would prevent the budget from taking effect while the case is pending. [F] The budget would take effect July 1. [F] Councilman Scott Kincaid said the budget is legal, and it's merely a case of sour grapes on the mayor's part.[F] The City of Flint cannot do something as elemental as debating, negotiating, compromising and passing a budget then runs to court again. This embarrasses us around the state. THIS MICHIGAN TAYLOR BRINGS FIRE TO OUR RIGHTS AND RAIN ON OUR JUSTICE They regard him as a narrow Republican partisan, a disgrace to the bench and have been campaigning desperately to defeat him when he runs for another eight-year term this November.[t] The fight has been so long ,so tough ,the stakes so high, victory so near in the Obama Democratic liberal sweep some will miss him when hes gone. Possible after the rightful battle and true victory Mark Brewer will pine a lament to Clifford Taylor.[trb]

THE MAKING OF THE END OF TAYLOR IS A HARD FOUGHT BATTLE, ITS NOT OVER ,YOUR HELP IS NEEDED Democratic State Chair Mark Brewer regularly denounces Taylor in speeches and in e-mail blasts. During last month's get-together of policy makers on Mackinac Island, Brewer passed out little pill bottles with a skull and crossbones, labeled "Injustice Incorporated."[t]

THE LEGAL OPINIONS TAYLOR PENNS SPEAK LOUDLY OF OUR RIGHTS BEING TRAMPLED ON Brewer made his case by criticizing a decision by the state Supreme Court to uphold a Michigan statute which prohibits lawsuits against drug companies for alleged damages caused by their products when those products have been approved by the FDA[f]

BRETHREN OF THE BENCH JOIN IN Even Justice Elizabeth Weaver rips the legislating tendency of the “majority of four” — Chief Justice Clifford Taylor, and Justices Maura Corrigan, Charles P. Young Jr. and Stephen Markman. In a ruling in Kreiner v. Fischer, she calls the four’s decision “an unrestrained misuse and abuse of the power of interpretation, masquerading as an exercise in following the Legislature’s intent, which needs to be corrected to comport with the actual text of MCL 500.3135.”[p]

WE BUY INSURANCE, WE GET HURT, THE COMPANIES DO NOT HAVE TO PAY At issue? Getting noneconomic damages as a result of an automobile accident. Prior to Kreiner, the law said an insured may collect “noneconomic” damages only when he or she has suffered a “serious impairment of body function” under Michigan’s No-Fault Act. For the last several years, courts have held that an injured person had suffered a serious impairment whenever the injury affected that person’s general ability to lead his or her normal life, according to the No Fault Resource Center.[p] What the Supreme Court did was change all that.[p] “Although some aspects of a plaintiff’s entire normal life may be interrupted by the impairment, if, despite those impingements, the course or trajectory of the plaintiff’s normal life has not been affected, then the plaintiff’s ‘general ability’ to lead his normal life has not been affected and he does not meet the ‘serious impairment of body function’ threshold,” wrote Justice Clifford W. Taylor.[p] Thus Mr. Kreiner, who could no longer work to the capacity he could before, was according to the majority of four generally able to lead his life — diminished as it was.[p] Say you’re injured in a car crash. Now try to determine the course and trajectory of your “normal” life, and try and figure out how “serious” the impairment has to be to get compensation after this ruling.[p]

THE LEADER OF THE PACK IS UP FOR ELECTION, ACCOUNTABILITY IS AT HAND Chief Justice Taylor is up for reelection this year, and the state Democratic Party won’t choose a nominee until this fall. Speculation is that the contest will cost $20 million, double the national record set in Illinois in 2004.[p]

MICHIGAN IS UNIQUE We’ve got a double whammy going in Michigan’s Supreme Court — one, we elect judges and thus make the elections open to campaign financing at a high level by interest groups of all stripes, and two, the state’s political parties nominate the judges who then run, tada, on the nonpartisan ballot.[p] Wiped of their ideological label, you’d like to think they’d be wiped of their ideological mindset as well. The law’s the law, isn’t it? No, it isn’t. And if you’re a plaintiff, good luck seeing any relief from this court.[p]

OUR STATE DEMOCRATIC PARTY AND ITS LEADERS ARE ON THE HUNT FOR JUSTICE... GO GETUM MARKEE... Actually, on closer inspection,...(the bottle Brewer handed out)... it was a little Cliff Taylor head and crossbones. Inside there was no pills, but a little slip of paper informing one that Justice Taylor was against Michigan families. However, he was in favor of making "it easier for sexual predators, drunk drivers and terrorists to avoid responsibility for their crimes." [t]

THE STATE CONVENTION IS THE SKIRMISH THE BATTLE IS IN NOVEMBER If it seems odd for a political party to be going after a judge like that, remember that Michigan has a very odd system. Nominees for the state supreme court are selected by the major political parties, not by any non-partisan nominating process.[t] It’s a new day and political house cleaning will sweep Michigan and the country. There will be peril in being labeled a conservative and no safe harbor by the Republican label or backing.[trb]

JUSTICES HIDE IN PLAIN SIGHT Once they are on the court, they then get a terrific advantage whenever they run for re-election: The ballot identifies them as "justice of the Michigan Supreme Court." People normally re-elect judges; that makes them virtually unbeatable. In fact, only one Supreme Court jurist has been defeated in modern history.[t] Yet given the full-bore attack the Dems have been waging on Justice Taylor and his record, you'd naturally assume they must have recruited a major heavy hitter to challenge him.[t] Q) So who is their candidate?[t] A) A mystery.[t] Thirteen days ago I happened to be at a Detroit dinner where Brewer was once again denouncing Taylor. "Do you have a candidate to run against him?" I asked.[t] "Yes, and we will announce who it is next week," he said. So I waited eight days, and then called Liz Kerr, the state Democratic Party spokesperson. WHEN ASKED WHO THE DEMOCRATIC SUPREME COURT CANDIDATE IS SOME RESPOND "Yes, and we're not saying who it is," she said. [t] Give the Democrats some credit; the idea of a stealth candidate is somewhat intriguing. If you could get away with that, it might help focus attention on the opposition's faults, without having to reveal your own weaknesses. Unfortunately, it isn't legal under Michigan law.[t] At some point, they will have to reveal who their candidate is.[t] "I don't know why they aren't saying," said Bill Ballenger, editor of Inside Michigan Politics and a longtime Lansing insider.[t] "Maybe they don't really have one yet, or all the factions in the party aren't sold on the one they want," he said. The most likely candidate is thought to be Marietta Robinson, a highly regarded Detroit attorney who ran against Taylor in 2000. That was the year Democrats spent millions in an effort to unseat three sitting Republican justices.[t] The incumbents, thanks in large part to their ballot designation, all won easily. Taylor won by half a million votes that time, even though it was a Democratic year elsewhere in Michigan.[t] So the odds are heavily against any challenger, which may be giving Robinson (and any other potential candidates) pause before pulling the rip cord and jumping into the fray.[t] What nobody seems to be asking, however, is whether this is all working for the people of Michigan. The state has one of the least collegial, most ideologically polarized high courts in the nation.[t] As it stands now, Michigan Supreme Court judges are essentially chosen by Republican or Democratic party bureaucrats.
